Local attorney Michael J. Walleri joined the defense team with Jason Gazewood to defend Andrew and Gloria Straughn, according to May 9, 2013 court records.
In 2008, the Straughns installed two outdoor wood boilers across the street from Woodriver Elementary School.

The state filed 20 witness affidavits in support of their case. 2 affidavits reference the number of citizen complaints filed since 2008.
According to the affidavit filed by James Conner, FNSB Air Quality Manager, 171 complaints from 42 different people were filed about poor air quality in the University West neighborhood in the past 5 years. 62 of the 171 complaints filed with the Borough identify one or both of the boilers owned by the Straughns.
According to the affidavit filed by Kristen Brown, Environmental Program Specialist for Alaska DEC, 187 complaints were filed about smoke in the Woodriver area since 2008. 91 of the 187 complaints filed with the state identified the Straughn boilers as the source of the smoke.
