On March 10, 2011, Alaska Department of Environmental Conservation issued a Nuisance Abatement Order to the owner of two outdoor wood boilers heating two duplexes located across the street from Woodriver Elementary School.
Residents need to continue to notify the Alaska DEC of any nuisance problems experienced due to smoke emissions from these OWBs. DEC inspectors must be notified of a problem and be able to verify a violation of the order for DEC to take the emitter to court. The order is not a ticket, as DEC does not have authority to issue tickets on air quality violations. The order itself carries NO fine. Only when a violation of the order is found, could there be any consequence. If found guilty in court, penalties could be up to $10,000 and a jail term up to 1 year.
Smoke emissions from the OWBs have plagued the University West neighborhood since the fall of 2008. High concentrations of fine particulate pollution may have also affected the Dale Road neighborhood and Watershed less than 1 mile away south and east across the Chena River.
Here are recent photos of the two outdoor wood boilers provided by Santa. He’s been volunteering in Woodriver Elementary School and visiting friends with children in the neighborhood and told us,
